GENERAL PURCHASE CONDITIONS:

These General Purchase Conditions shall regulate the sale of the products offered by CRIT D’OR, S.L. (hereinafter, "CRIT D’OR"), a company whose domicile is located at Palou Nord Industrial Park, Europa Ave. 14-16, 08401, Granollers (Barcelona), also regulating said company’s relationship with You (hereinafter, the "CUSTOMER"). The CUSTOMER's use of the services offered at the CRIT D’OR online shop implies, at all times, agreement with the General Purchase Conditions in the version published by CRIT D’OR at the time the order request is sent, said General Purchase Conditions being available to customers through the online shop. CRIT D’OR reserves the right to modify the General Purchase Conditions, as well as the products available and their prices, at any time. Said modified conditions shall not apply with retroactive effect to prior orders.

PURCHASE:

To purchase a product, the CUSTOMER must follow the instructions on the online shop. The CUSTOMER must select the product he/she is interested in purchasing by adding the product to the shopping cart. All product photos can be enlarged and information in relationship with the product reference number, description, weight and price shall be shown. To select a desired product, the CUSTOMER must click on "Add to the Shopping Cart" and, later, he/she will be given the option to continue shopping if he/she wishes to do so. To finalise the order, the CUSTOMER must be registered; otherwise, he/she may place an order as a "guest." Next, the CUSTOMER must choose where he/she would like to receive the product (the address used for registration or a different address). Finally, payment must be made. At the end of the process, the CUSTOMER will receive an email with a summary of his/her order.

In the event that, due to reasons unrelated with CRIT D’OR, the requested order cannot be delivered, CRIT D’OR shall notify the cancellation of the order to the CUSTOMER and shall return the amount paid for said order to the CUSTOMER within a maximum timeframe of 10 days. The CUSTOMER does not have the right to claim any other amount except for the amount paid. If the product is not available because of inventory problems, CRIT D’OR will get in touch with the CUSTOMER to offer him/her the possibility of saving the order until the product again becomes available, the possibility of cancelling the order or the possibility of modifying the order (with a similar product as a substitute or with a higher-range product at no additional cost, at the CUSTOMER's choice). Likewise, in the case of product lots, if –due to inventory problems– one of the components which make up a lot is not available, CRIT D’OR will notify the CUSTOMER, offering him/her a similar product as a substitute or a higher-range product at no additional cost to substitute the product from the lot which is unavailable. The CUSTOMER may cancel the order, accept the modification of the lot or save the order until the product becomes available again.

PRICES:

The prices shown on screen next to each product shall be expressed in euros and do include any Value Added Tax (VAT) which, if applicable, must be applied. When the order is finalised, the total amount for the selected products shall appear on screen, as well as the corresponding shipping fees for each case. This information shall likewise be shown in euros and with the corresponding VAT included in the prices.

CRIT D’OR reserves the right to make –at any time and without previous notice– any modifications and updates to products and prices that it deems necessary. The applicable price for the order made by the CUSTOMER shall be that which appears at the time that the General Purchase Conditions are accepted. CRIT D’OR likewise reserves the right to inform the CUSTOMER of any errors in price present in the order, with the CUSTOMER having the power to be able to cancel his/her order if the final price is different from that originally shown, with the customer being reimbursed –if applicable– for any amounts paid.

 

PAYMENT METHOD:

Payment shall be made via credit card. When the order is made, the full purchase price shall be paid, including shipping fees.

In the event that CRIT D’OR makes it possible to buy gift cards to be used at the online shop, payment for the order may be made with a gift card. In this case, the amount of the order (product amount plus shipping fees) shall be subtracted from the gift card's balance. In the event that the gift card's balance is less than the amount of the order, the CUSTOMER will have to pay the difference with a credit card.

Likewise, in the event that CRIT D’OR issues discount coupons to be used at the online shop, the CUSTOMER shall be able to use said discount coupons in accordance with their specific conditions as indicated by CRIT D’OR when said coupons are issued. The CUSTOMER may pay for all the order or a part thereof with the discount coupons, in which case the amount of the discount shall be subtracted from the order amount. If the amount of the order is less than that of the discount coupon, the CUSTOMER may pay for the order with the discount coupon; however, under no circumstance will CRIT D’OR return the difference to the CUSTOMER, nor will the CUSTOMER be able to reuse the discount coupon for other orders.

 

SHIPMENTS:

Shipping destination:

The products offered through the CRIT D’OR online shop are distributed nationally (except the Canary Islands, Ceuta and Melilla) and in the following countries: France, Germany, Austria, Belgium, Luxembourg, The United Kingdom, Holland (The Netherlands), Italy, Denmark, Hungary, Poland, The Czech Republic, Bulgaria, Estonia, Finland, Greece, Ireland, Latvia, Lithuania, Sweden, Slovakia, Romania, Bosnia and Herzegovina, Norway, Serbia and Switzerland. Shipping to other international destinations should be verified.

Delivery timeframes:

The delivery timeframe for products, beginning from when they are dispatched from our warehouses, is approximately 1 to 3 working days for deliveries to the Iberian Peninsula and 2 to 8 working days for deliveries to the Balearic Islands. The delivery timeframe for Member States of the European Union is 2 to 12 working days, approximately, from the time the shipment leaves our warehouses. For shipments outside of the European Union, the delivery timeframe is 5 to 15 working days, approximately.

These delivery timeframes are not guaranteed and may undergo modifications due to reasons unrelated with CRIT D’OR.

If the product is not available due to inventory or logistic problems, CRIT D’OR will get in touch with the CUSTOMER and will offer him/her alternative options as specified in the section of these General Purchase Conditions titled "PURCHASE."

Shipping fees:

Shipping fees for Spanish national territory are € 6.90 for orders less than € 69 (VAT included). For orders which are equal to or greater than € 69 (VAT included), shipping is free.

The shipping fees for international shipments shall be calculated by the website depending upon the weight of the shipment. These fees shall be shown on screen when the order is placed, before finalising payment.

The CUSTOMER shall assume any customs fees or taxes in relationship with the shipment.

Shipping address:

The CUSTOMER may select a shipping address which is different from the order's billing address.

 

RETURNS:

Due to the nature of the products sold at www.critdor.com (food products, perishables), CRIT D’OR shall not accept product returns.

Returns shall only be accepted in cases of shipping errors, defective products or products which are damaged in transport.

Returns due to shipping errors or defective products:

If the product is defective or there has been a shipping error, the CUSTOMER must notify this to CRIT D’OR in the maximum timeframe of 24 hours from the time the order is received.

CRIT D’OR shall give instructions on how to proceed so that the product may be replaced.

CRIT D’OR shall not be responsible for the arrival of shipping errors or defective products which has not been notified within the maximum timeframe of 24 hours.

CRIT D’OR shall not accept, under any circumstance, postage-due shipments.

Products which are returned because of shipping errors must be returned in perfect condition, in their original packaging, without having been opened and protected in such a way that they do not come in contact with transport seals or tapes. CRIT D’OR reserves the right to pay a lower amount to the CUSTOMER in the event that the product is not returned in the same state as when it was delivered to the CUSTOMER.

Returns of products damaged in transport:

If, once the order is received, the CUSTOMER notices that there are damages due to transport, the CUSTOMER must notify CRIT D’OR to this end in a maximum timeframe of 24 hours from the time the order is received.

CRIT D’OR shall give instructions on how to proceed so that the product which has been damaged in transport may be replaced.

CRIT D’OR shall not be responsible for the arrival of damaged products which has not been notified within the maximum timeframe of 24 hours.

CRIT D’OR shall not accept, under any circumstance, postage-due shipments.

 

APPLICABLE LAW:

These General Purchase Conditions shall be guided by Spanish law.
